These PayPal Business Profile Terms and Conditions (“Business Profile Terms”) are a legal agreement between you and PayPal (Europe) S.à r.l. et Cie, S.C.A. and apply to your creation, publication, access to and use of PayPal Business Profile.
By creating, publishing or using a Business Profile, you agree to these Business Profile Terms.
In these Business Profile Terms, “PayPal”, “we”, “us” or “our” means PayPal (Europe) S.à r.l. et Cie, S.C.A. “You” and “your” mean the holder of the PayPal business account using Business Profile.
These Business Profile Terms are a separate agreement that applies specifically to your use of Business Profile.
They apply in addition to your PayPal User Agreement, the PayPal Privacy Statement, the PayPal Acceptable Use Policy and any other legal agreements on the Legal Agreements page that apply to your use of PayPal. If there is a conflict between these Business Profile Terms and your PayPal User Agreement, these Business Profile Terms will apply to your use of Business Profile to the extent of that conflict.
Business Profile is a feature that allows eligible PayPal business account holders to create and publish a public business profile that can help customers discover the business and send payments through PayPal.
A Business Profile may include a public profile URL and business information selected by you, such as your business name, profile image, cover image, phone number, email address, website address and other business details.
Business Profile is available for business and commerce use only. It is not intended for personal, family or household use.
You may only create and use a Business Profile if you hold an eligible PayPal business account in good standing, comply with your PayPal User Agreement, the PayPal Acceptable Use Policy, these Business Profile Terms and any other agreement that applies to your use of PayPal, and provide information that is accurate, complete and not misleading. We may decide, in our sole discretion, whether your account or business is eligible to use Business Profile.
You are responsible for the information and content you choose to include in your Business Profile.
By creating or publishing a Business Profile, you confirm that:
You must promptly update your Business Profile if any information shown in it becomes inaccurate or out of date.
Your Business Profile is public. Before you publish it, and each time you otherwise make it publicly available through Business Profile, you acknowledge and agree that:
We may display your Business Profile, your public profile URL and the information you choose to make visible through the feature in PayPal products, services and experiences where we consider it appropriate to do so. Any such display does not mean that we endorse you, your business, your goods, your services or any statement made in your Business Profile.
If you previously used PayPal.Me or a legacy Seller Profile for merchant or commerce use cases, we may allow you to migrate your existing handle or profile information into Business Profile.
We may redirect, map, associate, retire, replace or otherwise manage legacy merchant-facing URLs, handles or entry points in connection with the launch, operation or migration of Business Profile. We do not guarantee that any particular legacy URL, handle, format or feature will remain available, unchanged or supported indefinitely.
We may assign, change, reassign, reclaim, remove or disable any Business Profile URL, handle or profile identifier at any time, including where we believe this is necessary for legal, regulatory, risk, security or operational reasons, where the URL or handle may mislead others or create risk, where your account is closed, restricted, suspended or no longer eligible, or where we discontinue, replace or change Business Profile or any related feature.
You do not acquire any ownership right in any Business Profile URL, handle or profile identifier merely because it has been made available to you.
You must not use Business Profile:
We may, where reasonably necessary and in accordance with applicable law, review, refuse, remove, suppress, limit, edit or disable any Business Profile or any content or information shown in it, restrict, suspend or terminate your access to Business Profile, require you to amend, remove or correct content or information, or change how Business Profile works, appears or is made available. We may do so where we reasonably believe this is necessary for legal, regulatory, risk, security or operational reasons, to prevent use of Business Profile that is unlawful, misleading or otherwise prohibited under the PayPal User Agreement or the PayPal Acceptable Use Policy , to address content that may infringe the rights of others, or to protect PayPal, our customers, third parties or the integrity of our services. Where appropriate, we will give you notice before taking action, but we may act without prior notice where this is reasonably necessary. These rights are in addition to any other rights we have under your PayPal User Agreement, PayPal Acceptable Use Policy or applicable law.
Our collection, use and sharing of personal data in connection with Business Profile is described in the PayPal Privacy Statement. Where Business Profile allows you to choose whether to display particular information publicly, it is your responsibility to manage those settings appropriately and to ensure that you are comfortable making that information public. If you provide personal data relating to another person in your Business Profile, you must have all necessary rights and permissions to do so and must comply with applicable data protection law.
To the extent needed for us to operate, display and make available Business Profile, you grant PayPal a non-exclusive, worldwide, royalty-free licence to use, host, store, reproduce, adapt, publish, display and distribute the content and information you include in your Business Profile. This licence is limited to the purposes of operating, improving, promoting, supporting and protecting Business Profile and related PayPal services.
Business Profile is provided as a feature of your PayPal account. We do not guarantee that your Business Profile will generate customer traffic, business leads, discoverability, rankings, payments or any particular commercial outcome. We also do not guarantee continuous availability of Business Profile, of any profile URL or handle, or of any feature, functionality, design, migration path or redirect behaviour.
The display of your Business Profile by PayPal does not mean that PayPal recommends or endorses you, your business, your products or your services.
You are solely responsible for your business, your customer communications, your customer service contact details, the content of your Business Profile, the goods or services you offer and any statement or representation you make through Business Profile and for ensuring that your use of Business Profile complies with the PayPal User Agreement, the PayPal Acceptable Use Policy and applicable law. PayPal is not responsible for verifying the accuracy of the information you choose to display in your Business Profile.
Your liability to PayPal and our liability to you in connection with Business Profile are governed by the liability provisions in your PayPal User Agreement, except to the extent these Business Profile Terms state otherwise or applicable law requires otherwise. Nothing in these Business Profile Terms limits or excludes liability where that would be unlawful.
We may change these Business Profile Terms from time to time.
If we make a change to these Business Profile Terms that affects our contractual relationship with you or the nature of Business Profile, we will post information on the Policy Updates page of our website and provide you with at least two months’ notice before the changes take effect, unless a shorter period is permitted or required under applicable law.
By continuing to use Business Profile or your PayPal account after any changes take effect, you agree to be bound by those changes.
If you do not agree to the proposed changes, you must stop using Business Profile and you may close your PayPal account before the changes take effect. See the “Closing your PayPal account” section of your PayPal User Agreement for more information.
Any necessary editing, including for typographical or calculation errors or other obvious mistakes, does not constitute an amendment to these Business Profile Terms.
We may also change, suspend or discontinue Business Profile, or any part of it, at any time, subject to applicable law and your PayPal User Agreement.
These Business Profile Terms apply until your access to Business Profile ends.
If your PayPal account is closed or terminated under the PayPal User Agreement, your right to use Business Profile will end automatically.
You may stop using Business Profile at any time by unpublishing or disabling your Business Profile. Closing your Business Profile does not by itself close your PayPal account. If you want to close your PayPal account, you must do so in accordance with the “Closing your PayPal account” section of your PayPal User Agreement.
We may terminate or suspend your use of Business Profile at any time in accordance with these Business Profile Terms, your PayPal User Agreement or applicable law.
Sections which by their nature should continue after termination will continue to apply, including sections relating to public content, migration, our rights, liability and intellectual property.
These Business Profile Terms are governed by the same law and subject to the same dispute resolution, jurisdiction and forum provisions that apply to your PayPal User Agreement.
